Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between you and Aesthi Technologies Inc., doing business as The Meow Picks, a company registered in Dover, Delaware (Reg. No. 10593109, EIN 42-2242249). By accessing themeowpicks.com, creating an account, or placing an order, you confirm that you have read, understood, and agree to these Terms, along with our Shipping Policy, Return & Refund Policy, and Privacy Policy, each incorporated into these Terms by reference.

If you do not agree to these Terms, please do not use this site or place an order. We sell exclusively to customers within the United States and these Terms are written accordingly.

Who may use this site

You must be at least 18 years old, or the age of majority in your state, and capable of forming a binding contract, to place an order with The Meow Picks. This storefront is intended for adult shoppers purchasing goods for their cats and is not directed at children. If you are under 18, you may use this site only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

Products, pricing & availability

We curate furniture, technology, and lifestyle products for cats from independent studios and manufacturers, organized into our Furniture (Climb, Perch, Sleep, Scratch), Technology (Fountains, Litter Boxes, Other Technology), and Lifestyle (Eat, Litter, Play, Travel, Wear, Accessories) categories. Every product page states price in U.S. dollars, materials, dimensions, and the maker behind the piece before you add it to your cart.

All prices are listed in USD and exclude applicable sales tax, which is calculated and displayed at checkout based on your delivery address. We make reasonable efforts to ensure pricing, descriptions, and availability shown on this site are accurate; where a pricing or listing error occurs, we reserve the right to correct it, cancel the affected order, and issue a full refund, and we will notify you before doing so.

We may modify, discontinue, or limit the availability of any product at any time, including items already featured on the site, without liability to you, except with respect to orders already confirmed.

Orders & order acceptance

Placing an order is an offer to purchase, which we may accept or decline. An order confirmation email confirms we have received your order, not that we have accepted it — your contract with us is formed when we send a shipping confirmation, or, for made-to-order furniture, when production begins. We may decline or cancel an order for reasons including suspected fraud, pricing or listing errors, unavailable inventory, or a delivery address we cannot serve, and we will refund any payment taken for a cancelled order in full.

You may cancel or amend an order at no charge any time before it enters fulfillment; see our Shipping Policy for the exact cut-off.

Shipping

We work with both domestic and international makers to curate what we sell, but every order is fulfilled from within the United States and shipped exclusively to addresses within the United States — we do not ship internationally.

• Order cut-off: 5:00 PM Eastern Time, Monday–Friday. Orders placed after cut-off, or on a weekend or holiday, begin processing the next business day.
• Processing time: 3–6 business days before your order ships.
• Transit time: 7–9 business days once your order leaves our fulfillment center.
• Shipping cost: weight-based and calculated automatically at checkout based on your cart and delivery address.

Full detail, including carriers, tracking, and how split or delayed shipments are handled, is set out in our Shipping Policy, which forms part of these Terms.

Returns, refunds & warranties

Most items may be returned within 15 calendar days of delivery, subject to the condition requirements, non-returnable categories, and return-shipping terms set out in our Return & Refund Policy. Approved refunds are issued to your original payment method within 10 business days of your return being received and inspected.

Where a manufacturer's written warranty applies to a product, it is stated on the product page and honored through us as your point of contact, in addition to the rights you hold under the Magnuson-Moss Warranty Act and applicable state law.

Account registration & security

Creating an account is optional but lets you track orders and save details for future purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at josh@themeowpicks.com if you suspect unauthorized use of your account. We reserve the right to suspend or terminate an account that we reasonably believe has been compromised, used fraudulently, or used in violation of these Terms.

Acceptable use

When using this site, you agree not to:

• Use the site for any unlawful purpose, or in violation of any applicable local, state, or federal law.
• Attempt to gain unauthorized access to our systems, other users' accounts, or non-public areas of the site.
• Interfere with or disrupt the site's operation, including through malware, scraping at scale, or automated bulk ordering intended to exploit pricing errors or limited-inventory drops.
• Submit false, fraudulent, or misleading information when placing an order or contacting support.
• Reproduce, resell, or exploit any part of the site or its content for commercial purposes without our written consent.

We may suspend or terminate access to the site or cancel orders where we reasonably believe these Terms have been violated.

Intellectual property & trademarks

The themeowpicks.com website, including its design, text, graphics, photography, and the "The Meow Picks" name and logo, is owned by Aesthi Technologies Inc. or licensed to us, and is protected by U.S. copyright and trademark law. You may not copy, reproduce, or use it for commercial purposes without our written permission.

The Meow Picks is an independent, multi-brand retailer. Maker and brand names shown on product pages — including studios such as MiaCara, Sophisticated Scratch, and PurrFriendlyLitter — belong to their respective owners. Listing a product does not imply that its manufacturer endorses, sponsors, or is formally affiliated with The Meow Picks, unless stated on that product's page. Payment method names and logos referenced in Section 05 belong to their respective owners.

Third-party links & services

This site may link to or rely on third-party services, including our payment processors, shipping carriers, and content referenced in our Journal. We do not control and are not responsible for the content, policies, or practices of third-party websites or services. Use of any third-party service linked from this site is at your own discretion and subject to that provider's own terms.

Disclaimers & limitation of liability

This site and its content are provided "as is" and "as available." Except for the express warranties stated in our Return & Refund Policy or on a specific product page, we make no other warranties, express or implied, regarding the site or products sold, including implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. Nothing in this section limits any warranty or consumer right that cannot lawfully be disclaimed under your state's law, including the implied warranty of merchantability recognized under the Uniform Commercial Code as adopted in every U.S. state.

To the fullest extent permitted by law, Aesthi Technologies Inc. will not be liable for indirect, incidental, special, or consequential damages arising from your use of this site or a product purchased from it. Our total liability for any claim relating to an order is limited to the amount you paid for the product giving rise to the claim. Some states do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

Indemnification

You agree to indemnify and hold Aesthi Technologies Inc. harmless from any claim, loss, or expense, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the site, or your violation of any law or the rights of a third party.

Governing law, disputes & your state's rights

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law principles, except where your state's consumer protection law requires that your state's law govern a particular dispute — in which case your state's law controls that specific issue, and the rest of these Terms remains in effect.

Before filing a claim against us, we ask that you first contact us at josh@themeowpicks.com so we can try to resolve the issue directly — most concerns are resolved this way without needing a formal dispute process.

Nothing in these Terms limits any right you hold under your state's consumer protection statute, including unfair and deceptive acts and practices (UDAP) laws in every state, the New York General Business Law, the California Consumer Legal Remedies Act, or similar state-specific consumer statutes, and nothing here waives your right to bring a claim in small claims court where your state permits it.

We may update these Terms from time to time as our business, products, or the law change. When we do, we will revise the "Last updated" date at the top of this page; continued use of the site after a change takes effect constitutes acceptance of the revised Terms.
